Before I take my time to answer the questions that you have posed, I may want to comment that I am a Internet Entreprenuer and have had multiple startups in past. You can look at my Linkedin profile.
I am amazed as the fact that this framework has been proposed. To start with the TSP has not set up the Internet infrastructure in India. They do provide the last mile infra and connect to the downstream network but the main internet-excahange infra is still nasect in our country with no proper exchange counters.
OTT (Over the Top) services is the main reason by which is the main attraction of internet and the digital world. It basically talks about innovation which anyone who has few thousand services can set up a service, shop etc to reach out to audience globally on the same platform.
Asking to regulate the OTT is same as asking all electrical and electronic companies to stop innovation as they use the same infrastructure that has been build by the Electrical distribution company. Imagine if each electrical company having a differential pricing for which device can run. If you run a Bulb and Fan, Rs 5, if you run a AC, Rs 100, if you run a TV set then Rs 20, if you run a LCD TV set above 40'' then Rs 40, if you have a computer than Rs 5, if you have a mobile then Rs 10. Luckily this did not happen even after 100 years of electricity and hence we see today how electricity has changed our lives.
The same can be said for internet. Imagine if every company charges different for different type of information, then the cost would be crazy both for consumer and the supplier. Human race and India in specific would take a step back.
We pay the internet provider company (TSP) based on the bandwidth and the data usage. What is carried on the data-pipe is irrelevant for TSP.
Please do not kill the startups and make-in-India even before it takes off.
