Question 1: Is it too early to establish a regulatory framework for OTT services, since internet penetration is still evolving, access speeds are generally low and there is limited coverage of high-speed broadband in the country? Or, should some beginning be made now with a regulatory framework that could be adapted to changes in the future? Please comment with justifications.
ANSWER : We definitely need a framework to give fair competition for everyone and yes, it should be allowed to evolve over the time without compromising the core philosophy. However, government and emergency apps/services should be FREE for all. For example, an apps to check railway information or apps for agriculture info or UPSC exam result etc - non commercial and beneficial informative apps/services should be free for all. This will help to increase the reach of internet to every nook and corner of our country. This will also help to curb corruption.
Question 2: Should the OTT players offering communication services (voice, messaging and video call services) through applications (resident either in the country or outside) be brought under the licensing regime? Please comment with justifications.
ANSWER : Yes and No. Yes for anyone who offered a paid services - make their income taxable and make sure they operate under India's legal jurisdiction to give fair chances to consumer. No for anyone offering free and innovative services. If they are not making money directly from consumer and its a innovative, new and beneficial service, lets not shackle under India's licensing regime. We need to do some study of overall global best practices of such licensing practices, to make it more enticing for such players to explore and operate in India.
